Marsha Harris has experience litigating catastrophic and high profile cases in both state and federal courts. She has handled matters through trial, including analyzing defense strategies, drafting and arguing pre-trial, dispositive and trial motions, preparing expert and fact witnesses for trial and deposing expert and fact witnesses. Ms. Harris is admitted to practice law in New York and Massachusetts. Ms. Harris’s areas of practice with the firm include toxic tort including lead paint and mold, labor law and premises liability. Ms. Harris has also defended hotels in premises liability actions, including claims for negligent security.
In the area of lead paint law, Ms. Harris has an expertise in New York Local Law 1 as well as litigation brought outside of New York City under Chapman v. Silber, which is an expansion of general negligence principles as applied specifically to lead based paint litigation. She has successfully defended matters against what are generally considered the top law firms, both downstate and in upstate New York. Ms. Harris has handled cases from inception to resolution including arguing appeals in the Second Circuit as well as the appellate divisions in the State Courts of New York. She has extensive experience in defending against the intricacies claimed in such cases including brain damage and its sequelae from a neurologic and neuropathologic perspective. Her proficiency in early assessment of liability and damages has resulted in reaching nominal settlements in early stages of litigation. Ms. Harris was a contributor to The Lawyer’s Guide to Lead Paint, Asbestos and Chinese Drywall.
