Mark A. Kanaga, a partner in the firm’s Wichita office, has extensive experience in labor and employment law and has represented employers in many types of employment litigation, including nationwide wage and hour class action cases, and single plaintiff discrimination and retaliation cases. Mr. Kanaga also has experience counseling employers regarding employment and traditional labor law issues, including employer responses to union organizing and strike activity, FMLA and other local leave laws. Mr. Kanaga has advised many clients across several industries, including technology clients, hospitals, biosciences companies, telecommunications clients, and many more.
Mark also has extensive experience handling traditional labor issues. His representations have included the defense and prosecution of unfair labor practice charges on behalf of management, negotiation and interpretation of collective bargaining agreements, and grievances and arbitrations arising under those collective bargaining agreements. Mark has represented employers with multiple bargaining units, and has handled strike prevention and response efforts as well as responses to union organizing efforts. Mark has also handled cases involving the interplay between the NLRB, EEOC, and other agencies that handle discrimination and retaliation issues.
In addition to employment litigation, Mr. Kanaga also has educational law experience, especially as related to the constitutionality of the funding of K-12 public education in Kansas. Mr. Kanaga represents a group of Plaintiffs who have successfully sued the State of Kansas alleging that the level of school funding in Kansas is unconstitutional. That litigation is ongoing. Mr. Kanaga is also involved in a counter-part to that lawsuit, which is currently pending in federal court. Mr. Kanaga has also represented students on a pro bono basis in their attempts to receive necessary special education services and funding.
Mr. Kanaga, like all attorneys in Lewis Brisbois’ Wichita office, is well versed and experienced in all aspects of insurance and insurance defense, including general liability, commercial liability, directors and officers liability, EPL, governmental entity defense, civil rights, constitutional law, education law, coverage, and professional negligence.
