Mr. Whiteley is a partner in the firm’s New York office, serving as co-chair of the OSHA Health & Safety Practice and vice chair of the nationwide Construction Practice Group, and supervising two trial teams. He specializes in the defense of construction cases under the New York Labor Law involving catastrophic accidents for several excess and primary insurance carriers. In addition, Mr. Whiteley has extensive experience in the defense and litigation of large economic damage claims for numerous regional and national construction firms and for several large public sector construction projects including the Second Avenue Subway and the East Side Access Tunnel. His practice also includes the defense of high-profile cases, including the Deutsche Bank Fire case in Lower Manhattan and the Con Edison Steam Pipe Explosion case in Midtown. Other areas of practice include premises liability, transportation, trucking, products liability involving construction equipment and hand tools, property damage, as well as other general liability and complex tort claims. Mr. Whiteley has served twice as the Co-Chair of an international consortium of construction law firms. He has extensive trial experience in both New York State and Federal Courts, and has lectured frequently on trial preparation, jury selection, construction litigation and other litigation topics that impact damages.
